Public Law Solicitors has considerable experience in advising and representing clients who have had difficulty exercising rights to information. These are examples of some recent PLS cases :

  • Social Services refused to provide a copy of a service user’s file to a carer on the ground that the service user did not have sufficient mental capacity to consent to its release
  • The Probation Service refused to provide details of personal information held on the ground that the information would be “mis-used” in some way
  • A local authority refused to provide details of planning documents used to make decisions about budget cuts on the ground that to disclose would inhibit free and frank discussion between council officers.
We are able to assist with complaints to the Information Commissioner, challenges by judicial review proceedings and best interests applications.
